Barry Morphew has filed a federal lawsuit against state investigators, FBI agents, prosecutors, and the local sheriff just over a year after murder charges against him in his wife’s disappearance and death were dropped for “irreparably” tarnishing his “name and reputation” with a “conspiracy to violate his state and federal constitutional rights.”
Morphew, now 55, claims that law enforcement and prosecutors ruined his life with an affidavit full of “falsehoods, material omissions, inaccuracies, and misleading statements” that fell far short of establishing probable cause in the alleged murder of his wife Suzanne Morphew, who vanished during a bicycle ride on Mother’s Day in 1997.

Morphew alleges malicious prosecution, unlawful detention, fabrication of evidence, reckless investigation, failure to Fisher & Byrialsen, PLLC, Samler & Whitson, PC, and Eytan Law LLC filed the case on Tuesday in the U.S. District Court for the District of Colorado, claiming that Barry was wrongfully accused, detained, prosecuted, and have his property seized.
“As a result of the Defendants’ actions, Barry spent nearly a year defending against the criminal accusations, approximately six additional months wearing a GPS ankle monitor with severe movement restrictions. Barry’s belongings are still in the CCSD’s custody as of this writing.

Although prosecutors claimed they were “close” to finding Suzanne’s body, the 11th Judicial District’s District Attorney Linda Stanley moved to dismiss the charges in April 2022. Shortly after District Court Judge Ramsey Lama became enraged by “consistent” discovery violations in the case, the nolle prosequi was issued.
The sudden exculpatory disclosure that unidentified male DNA — which surfaced in CODIS, a national DNA database maintained by the FBI — was connected to sexual assaults in Chicago, Illinois, as well as in Phoenix and Tempe, Arizona, was the “most obvious and egregious violation” of all, according to the judge.
The automobile owned by Suzanne contained that DNA. From the judge, citing a pattern of discovery violations that were “negligent, bordering on reckless”: Barry Morphew’s legal team had already filed a long ethics complaint against the prosecution, including the DA, prior to bringing the civil lawsuit, asking sanctions as severe as disbarment.
The DA’s office and law enforcement learned that the unidentified male DNA obtained from Suzanne’s vehicle matched that from unsolved sex offences across the country as early as December 2020, five months before Mr. Morphew’s arrest.
This extremely exculpatory information was concealed, not referenced by the prosecution during the preliminary hearings, not included in the affidavit for the arrest warrant, and not disclosed to the judge who signed the warrant, according to the complaint.In the civil case, additional parties are named as responsible, including the Chaffee County Sheriff’s Department, Sheriff John Spezze, Detective Robin Burgess, Deputies Randy Carricato and Scott Himschoot, Sergeants Claudette Hysjulien and William Plackner (sheriff’s office investigators), and Agents John Camper, Joseph Cahill, and Meg Smith of the Colorado Bureau of Investigation.
The father of two daughters in Colorado, Barry Morphew, claimed that the allegations that he killed Suzanne in a fit of rage because she had an affair and wouldn’t leave their marriage have “tarnished” his name forever. Barry claimed he had lost both his home and his job.
According to the complaint, “Barry’s name and reputation have been irreparably tarnished in Colorado and across the nation.” “Barry experienced considerable suffering and emotional misery, which included but was not limited to sadness, excruciating anxiety, chest pain, and insomnia.
Barry lost contact with his two kids, the oldest of whom was 17 at the time of his arrest and imprisonment. Due to the activities of the defendants, Barry had significant financial losses, including the loss of his home, business, savings, and much more.
Barry Morphew told ABC News in May 2022 that he adores his wife and daughters. “I just love my girls, and I love my wife,” he said. And all I want is for her to be found. Mallory and Macy, his kids, stood beside him.Mallory Morphew added, “We just know our dad better than anyone else and we know he was not involved in our mom’s disappearance,” while her sister Macy nodded.
The past couple of years have been the most agonising thing we’ve ever gone through. “We just miss our mum so much and want her to be found,” she continued.The District Attorney should “step up to the plate and do everything she can to find our mom,” said Macy, “because what they’ve done is not fair and we’re never going to stop looking for our mom.”
The Chaffee County Sheriff’s Department is required to train and monitor personnel “so as to prevent similar decisions being made in the future that result in the violations of individuals’ constitutional rights and conspiracies to do so,” according to the 12-count civil rights complaint. The complaint also asks for a jury trial, at least $15,000,000 in damages, attorneys’ fees and costs, the release of his property from law enforcement, and other relief.
