His attorneys claim that when they visited him in prison on Monday, they saw firsthand a “steep decline” in his manner, his capacity for understanding and communicating, and his ability to help defend himself. According to the motion, “said modification of Mr. Allen’s incarceration would result in a more humane living environment in which Mr. Allen would be afforded immediate access to his attorneys and, more importantly, would allow Mr. Allen to have regular contact visits with his family, i.c., this detention circumstance would afford Mr. Allen due process of law.”

According to Mr. Allen, the denial is a deliberate attempt to place restrictions on him that are meant to thwart his efforts to refute the alleged claims and put him through hardships that would cause any normal person to experience a mental collapse, according to a letter from his counsel. His Sixth Amendment rights are being directly violated by the way his pre-trial detention is being handled, according to the US Constitution.

In the twin 2017 murders of Abigail “Abby” Williams, 13, and her friend Liberty “Libby” German, 14, whose bodies were found in a forested location not far from the Delphi Historic Trails network, Allen is accused of two counts of murder.

On February 13, 2017, Abby and Libby disappeared while out on the Monon High Bridge Trail close to Delphi, Indiana. The trail passes an ancient trestle over a small river or brook and travels alongside a section of the Monon Railroad that has been abandoned. The following day, the girls’ bodies were discovered nearby the trestle.
