In addition to a long number of other complaints, the motion claims that Allen is forced to sleep on a pad on a concrete floor, only has access to two weekly showers, is not allowed to contact his wife or other family members, and is given very little time for amusement. According to the move, “Mr. Allen has been entombed in a cell as small as a 6 foot by 10 foot space, a space no larger than that of a dog kennel.”

“In conclusion, Mr. Allen is being treated far less favourably than a convict, many of whom are housed in less secure areas of the prison, are offered programming, therapy, and mental health services, routine recreation, and contact visits with family and friends,” the report reads.

The motion claims that Allen has been held in solitary confinement in a maximum security facility among people who have “committed some of the most heinous crimes known to our society,” and that the harsh surroundings have had a terrible impact on his physical and mental health.

His attorneys claim that when they visited him in prison on Monday, they saw firsthand a “steep decline” in his manner, his capacity for understanding and communicating, and his ability to help defend himself. Simply put, this Richard Allen was substantially different from the Richard Allen that Mr. Allen’s attorney had dealt with during the previous five months.

Counsel would characterise Mr. Allen as schizophrenic and deluded because of the variety of psychotic symptoms he displayed, according to his attorneys’ report. “Counsel further believes that in our interaction on April 4, 2023, Mr. Allen appears to be experiencing memory loss and is generally exhibiting an inability to communicate logically with counsel and family members,” says counsel.

The request stated that Allen is being held in a setting that may “casually be referred to as “death row”,” and attached a picture of him looking haggard and emaciated in comparison to images of him taken before his arrest.

Allen’s legal team asked that he be transferred to the recently built Cass County Jail, which is situated across the street from their office and provides more conventional facilities for a defendant in pretrial detention. According to the motion, “said modification of Mr. Allen’s incarceration would result in a more humane living environment in which Mr. Allen would be afforded immediate access to his attorneys and, more importantly, would allow Mr. Allen to have regular contact visits with his family, i.c., this detention circumstance would afford Mr. Allen due process of law.”

According to Mr. Allen, the denial is a deliberate attempt to place restrictions on him that are meant to thwart his efforts to refute the alleged claims and put him through hardships that would cause any normal person to experience a mental collapse, according to a letter from his counsel. His Sixth Amendment rights are being directly violated by the way his pre-trial detention is being handled, according to the US Constitution.

In the twin 2017 murders of Abigail “Abby” Williams, 13, and her friend Liberty “Libby” German, 14, whose bodies were found in a forested location not far from the Delphi Historic Trails network, Allen is accused of two counts of murder.

On February 13, 2017, Abby and Libby disappeared while out on the Monon High Bridge Trail close to Delphi, Indiana. The trail passes an ancient trestle over a small river or brook and travels alongside a section of the Monon Railroad that has been abandoned. The following day, the girls’ bodies were discovered nearby the trestle.
