The heartbroken husband, who suffered significant injuries in the collision that claimed the life of his new wife only seconds after they departed their wedding celebration in a golf cart, has launched a lawsuit against both the allegedly intoxicated motorist who struck them and the nearby bars who are believed to have served her “excessive” drink.
Aric Hutchinson, 36, filed the wrongful death lawsuit on Wednesday in the Ninth Judicial Circuit of the County of Charleston, South Carolina. He claimed that Jamie Komoroski, 25, was gravely negligent and reckless on April 28, which was supposed to be the happiest day of Samantha Miller’s and her new husband’s lives, at the time.

The day was perfect, and the wedding went off better than either of them could have imagined, the lawsuit began, sharing a picture of the “madly in love” newlyweds leaving their wedding reception, unaware of the horror that awaited them. Authorities claim that Komoroski got behind the wheel in Folly Beach with a.261 BAC — more than triple the legal limit — and sped up before hitting the golf cart in a “drunken haze.”
But according to the petition, “[w]hat began, and should have remained, the happiest day of Sam and Aric’s lives ended in a horrifying and unbelievably devastating, yet entirely preventable, tragedy.” Hutchinson’s Utah-based brother-in-law Benjamin Garrett, his wife Alexis, and their 17-year-old son Brogan have joined the action as plaintiffs. According to the lawsuit, Benjamin Garrett was operating the golf cart as his son sat next to him.

“Despite residing on James Island, Jamie Komoroski made the mistake of driving east on East Ashley Avenue in the opposite direction of her house while inebriated. Jamie Komoroski accelerated quickly as she travelled east on East Ashely Avenue, according to the lawsuit. Despite exceeding the 25 mph speed limit, Jamie Komoroski kept gaining speed. Jamie Komoroski, travelling at a speed of about 65 mph, smashed into the plaintiffs’ golf cart as it was being driven down Ashely Avenue.
According to the lawsuit, “Aric’s new bride, Samantha Miller, lost her life as a result of the violent and catastrophic collision and each of the Plaintiffs suffered terrible and permanent injuries.” Plaintiffs claimed that the numerous establishments that served the “noticeably and visibly intoxicated” Komoroski are equally accountable for negligence and wrongful death.
All defendants, including The Crab Shack, Taco Boy, The Drop In, Snapper Jacks, El Gallo, and 1 – 20 John or Jane Does, are accused of wrongful death and negligent infliction of mental distress. The ‘bar hopping’ Jamie Komoroski is being sued separately for gross negligence and recklessness.
Additionally, the plaintiffs accuse the bars of negligent, egregiously negligent, and/or reckless hiring, supervision, training, and retention. Komoroski’s employment at Taco Boy, one of the bars mentioned in the case, was made known by the lawsuit.
At one point in the lawsuit, Komoroski’s boss was charged with “organising, arranging, and supervising an employee function knowing that excessive amounts of alcoholic beverages would be purchased for, served to, and consumed by the employees attending the function.” Charleston attorneys Brian Mickelsen and Daniel Dalton filed the multi-count lawsuit.
The series of events leading up to the sad incident still have many unknowns, but by filing a complaint, we can start the legal discovery process and obtain the answers Samantha’s family is due, said Dalton in a statement. Only a few days had passed since Hutchinson made his first public comments regarding the unfathomable loss of his life’s love.
Aric Hutchinson stated of the memorial event, “She would have liked it. “Hello, Sam. She really is a beach girl at heart, after all. We do virtually daily morning walks here, and this is undoubtedly her send-off. She is undoubtedly grinning up there. Komoroski’s attorneys had already pleaded with the public not to pass judgement, promising that “all facts” will become clear.
