The parents of ninth-grader Marissa Barnwell are suing a South Carolina school alleging their daughter was accosted by a teacher for not stopping to recite the “Pledge of Allegiance” and walked into class instead. Suing Lexington School District 1, the River Bluff High School teacher and principal, and the South Carolina Department of Education, the student’s parents filed a lawsuit alleging that their daughter’s civil rights were violated along with the violation of Barnwell’s First Amendment free speech rights. as well as not talking at all. More than 30 years ago, a state law was passed to play the “Allegiance Pledge” in public schools every day at a specified time. However, that law also stated that as long as an individual does not infringe upon others or is not disruptive, he cannot be punished if he refuses to recite the oath. Family attorney Tyler Bailey declared, “The beautiful thing about America is that we have freedom,” adding, “Students in our schools should feel safe, they shouldn’t feel threatened for exercising their constitutional rights.”

Barnwell said that she “was just in disbelief” and she recalled telling the teacher, “Get your hands off me.” The student then contacted her parents and tearfully informed them of the incident. Parents claimed the district, teacher or principal did not respond, according to USA Today.
