The lawyer for an Arizona rancher being held on $1 million bail says her client did not shoot and kill the Mexican man whose body was found on his property last month near the US-Mexico border, but shot earlier that day warning shots at smugglers carrying AKs. -47 rifles and large backpacks on his land.
A defense request filed last week in Santa Cruz County Justice Court requests that the $1 million bail set in the first-degree murder case against George Alan Kelly be reduced or eliminated. Kelly, 73, remained in custody Monday at the Santa Cruz County Jail for the Jan. 30 slaying.

A preliminary hearing in the case is set for Monday, February 20. Attorney Brenna Larkin, who was appointed by the court to represent Kelly, said in her application that her client “admitted to firing warning shots at smugglers earlier that day, but she denied shooting anyone.” .
“He does not believe that any of his warning shots could have hit the person or caused death,” she continued. “All shots fired by Mr. Kelly on the date of the incident were in self-defense and justified.”
Kelly’s ranch is located just outside the Nogales, Arizona city limits in the Kino Springs area. The victim, Gabriel Cuen-Butimea, lived just south of the border in Nogales, Mexico. US court records show Cuen-Butimea was convicted of illegal entry and deported to Mexico multiple times, most recently in 2016.
The Mexican consulate in Nogales has not returned multiple calls seeking additional information about Cuen-Butimea. Kelly apparently drew on his ranching life in the borderlands in the self-published novel “Way Beyond the Border Fence,” which is described on Amazon.com as a “contemporary novel that takes the conflict between the Mexican border and drugs to the 21st century”.
Written by a man with the same name, the 57-page novel centers on George and his wife, Wanda. George Alan Kelly’s wife is also called Wanda. “Several times a week illegal immigrants would cross the VMR ranch,” one reads. “They were run by armed human traffickers called Coyotes. George and his foreman had to patrol the ranch every day, armed with AK-47s.”
Neighbor Maria Castillo told affiliate KOLD that it was not uncommon to see people who had crossed the border in the area, but that it was never a problem. “I drive here every day,” says Castillo. “Late, early and never found anyone, I feel very safe living here in the area.”
