Alec Baldwin will no longer face years in prison for the death of Rust cinematographer Halyna Hutchins after prosecutors dropped the firearms enhancement charge originally brought against the actor/producer. If Baldwin, 64, had been convicted on the manslaughter and firearms enhancement charges, he would have faced a mandatory five years in jail.
He still faces a manslaughter charge for shooting; that offense would carry a sentence of less than 18 months if he is convicted. The amended complaint was filed Friday night. The charge was also dropped against former Rust gunsmith Hannah Gutierrez-Reed, who faces the same manslaughter charge as Baldwin.

“To prevent further litigious distractions by Mr. Baldwin and his attorneys, the district attorney and special counsel have removed the firearms augmentation from manslaughter charges in the death of Halyna Hutchins on the set of Rust,” said Heather Brewer, a spokeswoman. the Santa Fe Prosecutor’s Office said in a statement on Monday. “The prosecution’s priority is to ensure justice, not to ensure billable hours for lawyers in big cities.”
Baldwin and Gutierrez-Reed were previously charged with two counts of manslaughter in connection with Halyna’s death on January 31. The actor also faces another civil charge. he sues Halyna’s parents and sister. In a statement to PEOPLE on January 19, Baldwin’s attorney, Luke Nikas of Quinn Emanuel, said the announcement of criminal charges against the actor “distorts the tragic death of Halyna Hutchins and represents a terrible miscarriage of justice.”
“Mr. Baldwin had no reason to believe that there was a live bullet in the gun, or in any part of the film set,” Nikas added. “He trusted the professionals he worked with, who assured him that the gun did not have real bullets. We will fight these charges and we will win.”
Rust is officially scheduled to resume production in the spring, more than a year after Hutchins was killed in a shooting in October 2021. Rust Movie Productions announced that director Joel Souza, who was injured in the shooting, is among at least four original members of the production team who will return to complete the film. A press release indicated that Hutchins’ widower, Matthew, will join the production as executive producer, along with Academy Award-nominated producer Grant Hill (The Thin Red Line).
