Sarah Sacuto, the widow of the late public health professor David Jones, filed a wrongful death lawsuit against the state, specifically, the MBTA and the Massachusetts Department of Transportation. The lawsuit follows the death of her husband after he fell down a rusty state-owned staircase, the Daily Mail reports. Jones was jogging in the morning when she ran up the steps of a closed and partially blocked staircase near the MBTA. Stop.
The steps were rusted beyond saving, causing them to collapse under Jones; he fell from a height of at least 20 feet. Now, a year after the professor’s unfortunate death, her widow has filed the suit in her individual capacity, on behalf of her husband’s estate and her children. It is not clear how much she has sued the state for. “The wrongful death of David Jones and the damage to his estate were the direct and proximate result of the defendant’s carelessness, recklessness, and negligence,” the lawsuit says.

Although the state had ruled the death an accident, Sacuto’s defense is that it could have been prevented if the state had properly blocked off the stairwell. “Defendants, through their negligence, allowed the ‘ladder in question’ to degrade and deteriorate, rendering it a hazard to the public,” the lawsuit states. “The defendants failed to take reasonable and appropriate steps to prevent the public from accessing the ‘attached ladder’ due to its dangerous and compromising condition.”
The lawsuit also says that her “wrongful death and damage to his estate were the direct and proximate result of carelessness, recklessness, and negligence.” The Boston Herald reports that neither the Massachusetts Department of Transportation nor the MBTA have issued any statements. “MassDOT does not provide public comment on pending litigation,” MassDOT spokeswoman Jacquelyn Goddard had reportedly written in an email.
An MBTA spokesperson also echoed the same sentiments. Joe Pesaturo said, “It is also the practice of the MBTA not to comment on pending litigation.” Interestingly, the MBTA had warned residents not to use the stairs in multiple tweets. In one such tweet, the MBTA said: “Reminder: The stairs between Columbia Road and Old Colony Avenue next to the JFK/UMass Station are inaccessible until further notice. Please access the station from Sydney Street or Morrissey Boulevard/Mont Vernon Street while necessary repairs are made. are being done.”
