A 20-year-old Michigan man who was charged with killing his 6-month-old daughter because she sobbed while he was playing video games entered a not guilty plea.According to court documents from the 42nd Circuit Court of Midland County that Law&Crime has obtained, Alex Lewis Marsh entered a plea of not guilty to second-degree murder last Thursday, Sept. 21. As a result, allegations of first-degree murder and child abuse were dropped.
Police from the Midland Police Department rushed to the house where Scarlett Marie Marsh was discovered dead on the morning of May 18, 2022, according to an affidavit in support of a criminal complaint that dates back to June 2022.Investigators discovered that the baby was being watched by the defendant from the evening of May 17, 2022, while the mother was at work. “Scarlett was declared dead by EMS immediately and they thought she had been dead for a time. The affidavit stated that EMS also noticed unusual-looking blood in the baby’s crib.

“Scarlett was discovered dead in the bedroom, lying on her back. Inside the baby cradle and under Scarlett’s nostrils, dried red blood that looked like liquid was visible. When questioned by police, the suspect allegedly stated that he left the mother of the infant at work, came home with the child, and that Scarlett went to bed at 10:30 p.m. on May 17, 2022.According to the accused, he got up two hours later—today, the following day—to rock the infant back to sleep.
Marsh claimed he checked on the infant once more after an hour. Marsh admittedly left the house at 6 a.m. that morning to pick up the baby’s mother from work without checking on the infant or taking Scarlett with him. The affidavit stated that Scarlett was found dead in the crib when the baby’s mother and Alex returned to the apartment. Scarlett’s mother allegedly told police that she raged at the defendant when he failed to bring the baby along when picking her up from work.
A second autopsy revealed “fixed lividity on the right side of [Scarlett’s] body (face and side) and on her back, but no external injuries.” According to the findings of the investigation, the infant was “moved some time after her death” and had blood in her chest cavity. The defendant allegedly admitted lying to authorities during a follow-up interview about checking on Scarlett after 6:30 p.m. on the day the infant died.The affidavit stated that Alex “then admitted Scarlett was weeping and that he threw a huge gray blanket over top of Scarlett in her crib and over Scarlett’s “entire body.
“The accused allegedly acknowledged that he removed the blanket from the crib before the police showed up. Alex Marsh was allegedly playing video games when Scarlett asphyxiated in her cot, according to police and the prosecution. According to reports, Midland County Chief Assistant Prosecutor Atea Duso claimed the defendant cared more about playing video games than taking care of his daughter during a 2022 court appearance.
The Midland Daily News quoted Duso as saying, “He was hesitant to play with her.” “He disliked using the baby monitor because he found it annoying. He desired to engage in video gaming.In Michigan, a person convicted of second-degree murder faces a sentence of “life, or any term of years, at the discretion of the court trying the same.” A sentencing date is not currently listed in court documents.
