When the child pleaded guilty, Dragisich said, “I’m aware that he was 13 years old, but my job and my obligation as the prosecutor of this county is to safeguard the public and hold people accountable for their actions. We will thus seek the maximum punishment permitted by law, which is a 40-year sentence for each offence, for a total of 80 years.
During his plea hearing, Crowe apparently hesitated to waive his rights, which twice caused the judge to halt the proceedings. The judge reportedly said, “There was a long pause there, and every time that happens to me it puts me on my heels.” “I would prefer to have every defendant go through a trial in front of me, all the time. I don’t want anyone to plead guilty who is even somewhat uncertain.
I’ll give it another go; why the hesitation? Crowe admitted guilt following discussions with his lawyer and a little more back and forth between the court and the solicitors involved. In the end, the judge accepted the plea, cautioning the defendant that he would have had more chance having a jury impose a lighter punishment. And Crowe specifically requested that from the court in motions.
The request was rejected by Cuomo. The judge reportedly added, “You’re asking this court for something less than the maximum so that you can make something of yourself,” as quoted by ABC/CBS/MyNetworkTV affiliate WTRF in Wheeling, West Virginia. What you’re asking is that. You have said that in the file. I believe that a week or two ago, your sister would have received her high school diploma. She won’t ever get that chance.
She won’t ever be able to attend college. She will never be able to take the wedding vows, get hitched, or have children of her own. You robbed her of that. She was never given the chance to succeed, yet you want me to do the same for you. Crowe received the maximum penalty of 40 years in prison for each murder, as asked by the state. The sentences will be carried out consecutively or one after the other, according on Cuomo’s decision.
The prosecutor stated, according to WTRF, “It’s my duty to protect the public and keep everyone safe and the most effective way to do that was for him to be sentenced to the maximum amount.” And I’m confident that the judge shared my opinion. He was looking at a minimum of 10 years in prison for each murder.
The reason behind the violence has never been identified. After the plea hearing last year, Dragisich said, “Yeah, no terrific explanation, and I don’t think we’ll really understand why,” according to remarks obtained by the Fox affiliate WTOV in Steubenville, Ohio. Crowe will be sent to an adult facility when he becomes 18 years old. At that point, a different hearing will be held to decide where he goes. After serving 15 years behind prison, he will be eligible for release.
